PREAMBLE

These Terms of Sale (“Terms”) govern all purchases of La Sambara wine products made through the La Sambara Estate website at www.lasambara.com (“Site”). La Sambara Estate is a brand owned and operated by Seven Mavericks Limited, a company registered and incorporated under the laws of the Republic of Kenya (“Seven Mavericks”, “we”, “us”, or “our”).

By placing an order on the Site, you (“Customer”, “you”, or “your”) confirm that you have read, understood, and agree to be bound by these Terms of Sale, together with our Terms and Conditions of Use and Privacy Policy, all of which are incorporated herein by reference.

IF YOU ARE UNDER 18 YEARS OF AGE, YOU ARE STRICTLY PROHIBITED FROM PURCHASING OUR PRODUCTS.

Seven Mavericks Limited is duly licensed to produce, distribute, and sell alcoholic beverages in accordance with the Alcoholic Drinks Control Act (Cap. 121) of Kenya and all applicable Kenya Bureau of Standards (KEBS) requirements.

2. AGE RESTRICTION AND ALCOHOL COMPLIANCE

La Sambara products are alcoholic beverages. You must be at least eighteen (18) years of age to purchase our products. By placing an order, you confirm and warrant that:

• You are 18 years of age or older;
• You are legally entitled to purchase alcoholic beverages in your jurisdiction;
• You will not make our products available to persons under the legal drinking age;
• You have read and understood the mandatory health warnings set out above.

We reserve the right to request proof of age at any point during the purchase or delivery process. Orders confirmed to have been placed by persons under 18 years of age will be cancelled and any payment received will be refunded in full.

3. PRODUCTS

La Sambara Estate produces organically grown and vinified wines including, but not limited to:

• Chenin Blanc — organically grown in the highlands of Meru, Kenya
• Shiraz — organically grown in the highlands of Meru, Kenya

All products are sold subject to availability. Product descriptions, tasting notes, vintage information, and imagery on the Site are provided for informational purposes only. While every effort is made to ensure accuracy, minor variations in taste, colour, and aroma between vintages may occur due to natural agricultural variation.

Each bottle of La Sambara wine is labelled in compliance with Kenyan law, including:

• Volume: 750 ml
• Alcohol by Volume (ABV): as specified per product (typically 12% Vol)
• Ingredients: Fermented Grape Juice
• Country of Origin: Product of Kenya
• Storage: Serve chilled 8–10°C; Store in a cool, dry place
• Producer: Seven Mavericks Limited, La Sambara Estate, P.O. Box 28, 60200 Meru, Kenya

Seven Mavericks Limited reserves the right to discontinue, modify, or substitute any product at any time without prior notice.

4. PLACING AN ORDER

4.1 By placing an order on the Site, you are making an offer to purchase products subject to these Terms. All orders are subject to acceptance and availability confirmation by Seven Mavericks Limited.

4.2 A binding contract of sale is formed only upon our written confirmation of your order, which will be sent to the email address you provided at checkout.

4.3 We reserve the right to refuse any order at our sole discretion, including but not limited to orders where:

• Age verification cannot be confirmed;
• Payment cannot be authorised;
• Products are no longer available;
• An error in pricing or product description has occurred;
• The order appears to be fraudulent or in breach of these Terms.

4.4 Where we are unable to fulfil your order, we will notify you promptly and issue a full refund of any payment received.

5. PRICING AND TAXES

5.1 All prices displayed on the Site are quoted in Kenya Shillings (KES) and are inclusive of applicable taxes unless otherwise stated.

5.2 Prices are subject to change at any time without prior notice. The price applicable to your order is the price confirmed at the time of placing your order.

5.3 We take all reasonable care to ensure that prices displayed on the Site are accurate. In the event that a pricing error is identified after your order has been placed, we will contact you to confirm whether you wish to proceed at the correct price or cancel your order and receive a full refund.

5.4 Delivery charges, where applicable, will be displayed separately during checkout and will be included in your order total prior to payment.

6. PAYMENT

6.1 Full payment must be received and confirmed before any order is processed or dispatched.

6.2 We accept the following payment methods:

• Major credit and debit cards (Visa, Mastercard)
• Mobile money (M-Pesa)
• Such other payment methods as may be made available on the Site from time to time

6.3 All payment transactions are processed through secure, encrypted third-party payment gateways. We do not store your complete card details on our servers. Payment data is handled in accordance with PCI-DSS standards.

6.4 In the event that payment is declined or fails, your order will not be processed. You will be notified and invited to retry with an alternative payment method.

6.5 Receipt of payment confirmation does not constitute acceptance of your order. Acceptance is confirmed only upon our written order confirmation email.

7. TITLE AND RISK

7.1 Title to and ownership of the products shall pass to you upon receipt of full payment and our written confirmation of your order.

7.2 Risk of loss or damage to the products shall pass to you upon delivery of the products to the delivery address specified in your order.

8. CANCELLATIONS

8.1 You may request cancellation of a confirmed order by contacting us at info@lasambara.com as soon as possible after placing your order.

8.2 Cancellation requests received before the order has been dispatched will be honoured, subject to an administration fee of ten percent (10%) of the total order value. The balance will be refunded to your original payment method within thirty (30) days.

8.3 Once an order has been dispatched, cancellation is not possible. In such circumstances, you may submit a return request in accordance with our Refund and Cancellation Policy.

8.4 Seven Mavericks Limited reserves the right to cancel any order at any time for reasons including, but not limited to, product unavailability, pricing errors, or failure to verify customer age. In such cases, a full refund will be issued within thirty (30) days.

9. GOVERNING LAW

These Terms of Sale are governed by and shall be construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or from the sale and purchase of La Sambara products shall be subject to the jurisdiction of the courts of Kenya, in accordance with the dispute resolution provisions set out in the La Sambara Estate Terms and Conditions of Use.
