These Terms and Conditions (“Terms”) govern your access to and use of the La Sambara Estate website at www.lasambara.com (the “Site”), any associated mobile platforms, and the purchase of La Sambara wine products (the “Products”). La Sambara Estate is a brand owned and operated by Seven Mavericks Limited, a company registered in Kenya and incorporated under the laws of the Republic of Kenya (“Seven Mavericks”, “we”, “us”, or “our”). La Sambara products are produced at La Sambara Estate, P.O. Box 28, 60200, Meru, Kenya.

By accessing the Site, placing an order, or otherwise engaging with our brand, you (“User”, “you”, or “Customer”) confirm that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease use of the Site and refrain from purchasing our Products.

IF YOU ARE UNDER 18 YEARS OF AGE, YOU MUST NOT USE THIS SITE OR PURCHASE OUR PRODUCTS.

ACCEPTANCE OF TERMS

By using this Site in any manner, you are deemed to have accepted all Terms unconditionally. These Terms may be updated at any time without prior notice. Continued use of the Site after any changes constitutes your acceptance of the revised Terms. We recommend you review these Terms periodically. All references to “our”, “us” or “we” within these Terms refer to Seven Mavericks Limited, trading as La Sambara Estate.

Seven Mavericks Limited is licensed to produce, distribute, and sell alcoholic beverages in accordance with the Alcoholic Drinks Control Act (Cap. 121) of Kenya and all applicable subsidiary legislation and Kenya Bureau of Standards (KEBS) requirements.

AGE VERIFICATION AND ALCOHOL REGULATIONS

La Sambara products are alcoholic beverages. The following mandatory Kenyan regulatory requirements apply to all transactions and interactions:

3.1 Mandatory Warnings

In compliance with the Alcoholic Drinks Control Act and KEBS standards, the following warnings apply:

3.2 Age Restriction

You must be at least eighteen (18) years of age to use this Site, purchase our Products, or engage with any promotional material relating to La Sambara. By accessing the Site or placing an order, you confirm and warrant that you are 18 years of age or older. We reserve the right to request proof of age at any time during the purchase or delivery process. Orders placed by persons under 18 years of age will be cancelled and any associated payments refunded.

3.3 Responsible Consumption

La Sambara Estate and Seven Mavericks Limited are committed to the responsible sale and consumption of alcohol. We encourage all customers to drink responsibly and in moderation. La Sambara products are not intended for resale to minors and must not be made available to persons under the legal drinking age.

3.4 KEBS Compliance

All La Sambara products are manufactured, labelled, and distributed in compliance with applicable Kenya Bureau of Standards (KEBS) regulations, including relevant standards applicable to wine and alcoholic beverages. Our products carry applicable regulatory identifiers on all labels including barcode, batch number, ABV percentage, volume, and country of origin declarations as required by Kenyan law.

PRODUCTS AND DESCRIPTIONS

La Sambara Estate produces wines including, but not limited to, Shiraz and Chenin Blanc, organically grown and vinified from vineyards nestled in the regions of Meru, Isiolo, and Samburu, Kenya. Product descriptions, tasting notes, and imagery on the Site are provided for informational purposes only. While every effort is made to ensure accuracy, minor variations in taste, colour, and aroma between vintages may occur due to natural agricultural variation.

All products are sold subject to availability. Seven Mavericks Limited reserves the right to discontinue, modify, or substitute any product at any time without prior notice.

Each bottle of La Sambara wine is labelled in accordance with Kenyan law, including:

Volume: 750 ml

Alcohol by Volume (ABV): as specified per product (typically 12% Vol)

Ingredients: Fermented Grape Juice

Country of Origin: Product of Kenya

Storage Instructions: Serve chilled 8–10°C; Store in a cool, dry place

ORDERS, PAYMENT, AND PRICING

5.1 Placing an Order

By placing an order on the Site, you are making an offer to purchase products subject to these Terms. All orders are subject to acceptance and availability. A binding contract is formed only upon our written confirmation of your order. We reserve the right to refuse any order at our discretion.

5.2 Pricing

All prices displayed on the Site are in Kenya Shillings (KES) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you place your order.

5.3 Payment

We accept payment via major credit and debit cards, mobile money platforms (including M-Pesa), and such other payment methods as may be made available on the Site from time to time. All payment information is processed through secure, encrypted payment gateways. We do not store card details on our servers. Full payment must be received before any order is processed.

DELIVERY POLICY

6.1 Delivery Timelines

Subject to availability and receipt of full payment, orders will be processed within five (5) to seven (7) working days. Delivery confirmation will be sent by email. Delivery timelines may vary depending on your location within Kenya and are subject to conditions beyond our control, including public holidays, adverse weather, and logistics disruptions.

6.2 Delivery Requirements

In accordance with Kenyan law, alcoholic beverages must not be left unattended at a delivery address. A responsible adult aged 18 years or older must be present to sign for and accept delivery. Failure to ensure a responsible adult is present may result in the redelivery of your order at additional cost or cancellation of the order.

6.3 Geographic Restrictions

Our delivery services are currently available within the Republic of Kenya only. Export of alcoholic beverages from Kenya is subject to applicable export licences and regulations. We do not currently offer international shipping through this Site.

RETURNS AND REFUNDS POLICY

La Sambara products are perishable goods. We will consider returns or refunds only in the following circumstances:

The product received is defective or has been damaged in transit — please notify us within 48 hours of delivery with photographic evidence;

The product does not match your confirmed order (e.g., wrong varietal or vintage);

The product is unavailable and cannot be fulfilled — in which case we will issue a full refund within thirty (30) days.

Cancellation of confirmed orders by the customer will be subject to an administration fee of ten percent (10%) of the total order value. Refunds will be processed to the original payment method within thirty (30) days of approval. We do not accept returns of opened or partially consumed bottles unless a quality defect is identified.

INTELLECTUAL PROPERTY AND BRAND PROTECTION

8.1 Ownership

All intellectual property rights in and to the La Sambara brand, including but not limited to the following, are exclusively owned by Seven Mavericks Limited or its licensors:

The La Sambara scriptive logo and logotype in all versions (dark, light, and product-specific variants)

The Seven Mavericks (7M) crest and holding company marks

All brand colours, including Pantone 580 C, Pantone 577 C, Pantone 433 C, Pantone 4999 C, Pantone 4975 C, and associated digital equivalents

The primary typeface (Restora) and secondary typeface (Source Sans Pro) as applied in brand communications

The vineyard landscape illustration and all associated secondary graphic elements

All label designs, including the Chenin Blanc and Shiraz label constructs (front and back)

All stationery, packaging, signage, promotional materials, and brand applications as depicted in the La Sambara Brand Manual

The domain names lasambara.com and sambara.co.ke

8.2 Permitted Use

You may access and view the Site and print a single hard copy of materials for your personal, non-commercial use only. No other reproduction, copying, adaptation, transmission, or commercial exploitation of any content on this Site is permitted without our prior written consent.

8.3 Brand Usage Prohibitions

Consistent with the La Sambara Brand Manual, the following uses of our brand assets are strictly prohibited without prior written authorisation from Seven Mavericks Limited:

Altering or placing the La Sambara logotype on a single line contrary to its designed two-line configuration

Adding any elements, marks, or decorations to the La Sambara logo symbol

Altering the logotype style, font, or calligraphic characteristics

Using colours outside the approved La Sambara colour guidelines, including applying the logo in green, unauthorised tints, or any unapproved colour

Distorting, stretching, compressing, or otherwise altering the proportions of the logo, whether vertically or horizontally

Modifying the opacity or transparency of the logo mark

Using the La Sambara name, logo, or brand materials in any manner that could mislead consumers or imply an endorsement, partnership, or association with Seven Mavericks Limited without our express written consent

Reproducing the brand in connection with content that is defamatory, unlawful, harmful, or otherwise contrary to applicable Kenyan law or our ethical standards

8.4 Enforcement

Seven Mavericks Limited reserves the right to take all necessary legal action to enforce its intellectual property rights, including seeking injunctive relief, damages, and any other remedies available under the Industrial Property Act (Cap. 509), the Copyright Act (Cap. 130), the Trade Marks Act (Cap. 506), and any other applicable Kenyan law.

USER OBLIGATIONS

By using this Site, you agree to:

Provide accurate, complete, and truthful information when placing orders or registering on the Site;

Comply with all applicable Kenyan laws, including the Alcoholic Drinks Control Act, when purchasing, receiving, and consuming La Sambara products;

Not impersonate any person or entity, or misrepresent your identity or affiliation with any person or organisation;

Not use the Site for any unlawful purpose, including but not limited to the purchase of alcohol for persons under 18 years of age;

Not upload, transmit, or distribute any viruses, malware, or harmful code to the Site;

Not attempt to gain unauthorised access to any part of the Site or its underlying systems;

Not engage in any conduct that could damage, disrupt, or impair the Site or interfere with other users’ experience;

Not use automated tools, bots, scrapers, or similar technologies to extract data from the Site without our prior written consent.

ACCESS TO THE SITE

We do not guarantee that the Site will be available at all times. Access may be suspended, restricted, or withdrawn without notice for maintenance, upgrades, security reasons, or other operational requirements. We are not liable for any loss, inconvenience, or damage arising from any period during which the Site is unavailable.

NO WARRANTIES

The Site and all content, materials, and information available on it are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by Kenyan law, Seven Mavericks Limited excludes all implied warranties, conditions, representations, or terms that might otherwise apply to the Site or its content, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be free from errors, inaccuracies, omissions, or viruses. Information on the Site may become out of date, and we undertake no obligation to update it unless required by law.

PRODUCT LIABILITY

La Sambara wines are produced and bottled under stringent quality control measures at La Sambara Estate in Meru, Kenya, in compliance with applicable KEBS standards. While we take all reasonable steps to ensure the quality and safety of our products, we are not liable for any adverse health effects arising from the consumption of alcohol generally, or from misuse, overconsumption, or consumption by persons for whom alcohol is contraindicated (including persons under 18 years of age, pregnant women, or persons on medication).

If you believe a product you have received is defective, you must notify us at info@lasambara.com within 48 hours of receipt, providing full details and supporting evidence. We will investigate all quality complaints and respond within a reasonable time.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable Kenyan law, Seven Mavericks Limited shall not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from or in connection with:

Your use of, or inability to use, the Site;

Any reliance placed on information, materials, or content on the Site;

The purchase, delivery, consumption, or use of La Sambara products;

Unauthorised access to or alteration of your data or transmissions;

Any events beyond our reasonable control (force majeure).

You agree to indemnify and hold harmless Seven Mavericks Limited, its directors, officers, employees, agents, and licensors from and against any loss, damage, claim, or expense (including legal costs on an attorney-and-own-client scale) arising from your breach of these Terms or your use of the Site or Products.

PRIVACY AND DATA PROTECTION

Seven Mavericks Limited is committed to protecting your personal information in accordance with the Kenya Data Protection Act, 2019 (Act No. 24 of 2019). We collect, process, and store personal data only to the extent necessary to fulfil your orders, improve our services, and comply with applicable legal obligations.

By using our Site, you consent to the collection and use of your personal information as described in our Privacy Policy, which is available on the Site. We will not sell, rent, or disclose your personal data to third parties except as required by law or as necessary to fulfil your order.

THIRD-PARTY LINKS

The Site may contain links to third-party websites for informational purposes. We do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website. Accessing third-party sites via links on our Site is at your own risk.

RESTRICTION, SUSPENSION, AND TERMINATION

We may, at our sole discretion and without prior notice, restrict, suspend, or terminate your access to the Site or any of its features if we believe you have breached these Terms, engaged in unlawful conduct, or acted in a manner that could cause harm to us, other users, or third parties. Any such action is without prejudice to any other rights or remedies we may have.

FORCE MAJEURE

We shall not be in breach of these Terms or liable for any delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, government actions, industrial disputes, or failure of third-party suppliers or logistics providers.

GOVERNING LAW ANDJURISDICTION

These Terms and any dispute, controversy, or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Kenya, and Seven Mavericks Limited nominates its registered address at P.O. Box 28, 60200, Meru, Kenya as its domicilium citandi et executandi for all legal purposes.

DISPUTE RESOLUTION

In the event of any dispute arising from these Terms or from the purchase of La Sambara products, the parties agree to first attempt to resolve the matter through good-faith negotiation. If such negotiation fails within thirty (30) days of written notice, the parties may refer the dispute to mediation under the Kenyan Dispute Resolution Centre (KDRC) or such other mutually agreed body. If mediation fails, the dispute shall be referred to the courts of Kenya as provided in Section 18.

VARIATION OF TERMS

Seven Mavericks Limited reserves the right to amend, revise, or replace these Terms at any time at its sole discretion. Updated Terms will be published on the Site with a revised effective date. It is your responsibility to review these Terms regularly. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.

SEVERABILITY

If any provision of these Terms is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect. The invalid provision shall be interpreted so as to most closely reflect the original intent of the parties, to the extent permitted by law.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and Seven Mavericks Limited with respect to the subject matter hereof, and supersede all prior negotiations, representations, warranties, and understandings, whether written or oral.
